NCSBT Risk Management Programs

Errors & Omissions/General Liability TrustNCSBA continues to offer risk management protection to its membership through the NCSBT Errors and Omissions/General Liability Fund and the NCSBT Automobile/Inland Marine Fund. One important benefit of participating in the NCSBT programs is that boards of education do not waive their governmental immunity from certain claims by participating in NCSBT. Boards of education do waive their governmental immunity by purchasing commercial insurance. Errors and omissions coverage−sometimes called school board liability or wrongful acts−primarily provides coverage for liabilities arising out of alleged violations of employee rights or student rights. Because of the potential of a finding of personal liability by a court, it is imperative that school districts and school employees have this protection. General liability, simply stated, provides coverage for bodily injury and property damage liability arising out of the operation and maintenance of school premises and/or school programs. Also included are personal injury exposures such as libel, slander and defamation of character. The fund provides protection for the school district, board of education members−individually and collectively, all school employees, student teachers and school approved volunteers. Limits of liability for errors and omissions exposures and general liability exposures are $1 million, with a $5000 deductible for each claim. *Higher limits of coverage are also available.* *Covered claim amounts that exceed the NCSBT fund limits (retention) are covered by excess insurance.
